  1. I understand that application has been/is to be made to the Supreme Court for an order for the sequestration/voluntary surrender of the estate of the Debtor and for the placing of the Debtor in provisional liquidation/under judicial management.


  1. I declare that ________________________________________________________(“the Creditor”) is a creditors of the Debtor.


  1. In my opinion it is in the interest of the creditors of the Debtor that a provisional trustee/liquidator/judicial manager be appointed in the estate of the Debtor for the reasons set out hereunder:- TO TAKE CONTROL OF THE ASSETS


  1. I hereby nominate CHRISTOPHER JAMES ROOS of SEBENZA TRUST, P O Box 14527, HATFIELD, 0028; Telephone number (012) 7555225 for appointment as the provisional trustee/liquidator/judicial manager and request you to make the necessary appointment. The Creditor intends proving a claim and voting for the final appointment of the aforementioned person at the first meeting of creditors in this estate.


  1. I declare that the Creditor is not a person disqualified, in terms of the provisions of Section 52 and 53 of the Insolvency Act and Section 365(2)(a) of the Companies Act, from voting for the appointment of the aforesaid person as trustee/liquidator/judicial manager.  As far as I am aware the nominated person is not disqualified from the aforesaid appointment by virtue of the provisions of Section 55 of the Insolvency Act or Section 372 of the Companies Act.


  1. I further declare that I have satisfied myself that the amount reflected herein as owing by the Debtor to the Creditor is, to the best of my knowledge and belief, true and correct.

  1. In the case of a company this form is to be signed by a director or otherwise by any other person duly authorised thereto in terms of a resolution, a copy of which must be attached.
  2. If signed under power of attorney, the original or a copy thereof must be attached.
  3. Kindy note that a requisition is not a claim form and that a claim must be submitted on the correct forms at a meeting of creditors.
  4. I hereby call up on revoke any other Nomination / Requisitions Forms signed before this date as stared above

I see that there is now different email for sending form! Will there be any problems if we already sent filled form on the adress thet was in past news?

How can one print and complete form and then e-mail?

    OPTION 1 – I can print and scan:

    Print the form sign it with black pen, scan to your device and email to the correct email address per above.

    OPTION 2 – I can print, but not scan:

    Print the form sign it with black pen, take a PROPER photo with your phone, tablet, etc and email to the correct email address per above.

    OPTION 3 – I CANT print or scan (can sign on my phone):

    Sign the document using your phone.
    Save to PDF.
    Send the document to the email address provided.

    OPTION 4 – I CANT print or scan (can’t sign on my phone):

    Take a small piece of paper, just big enough for your signature to fit.
    Sign the piece of paper with your black pen.
    Take a photo of the signed paper.
    Open the nomination letter and PASTE the photo taken of the signature on the form at the signature section.
    Complete the rest of the form.
    Make sure form is in PDF format.
    Email to the relevant email address.

In terms of your commission as the liquidator I would like to know what percentage you will be charging in the event of retrieving my assets and / or should there be no funds to be claimed am a in anyway liable for your services?

Good day I think it would be if the requistion form would be sent in an email so that once it’s filled in then it’s send back. I honestly don’t understand how must I do this

    Capacity: Individual investor (if you are doing it in your personal capacity). Full name & capacity: Your full names and surname and then Individual investor.

Hi, I was about to signup this form, but seeing only a P O Box 14527, HATFIELD, 0028 address, of Mr CHRISTOPHER JAMES ROOS of SEBENZA TRUST, made me wonder again.

Shouldn’t we have know where we can truly find him? Will we be give the exact legal identity of him such as passport or driver license for future reference? Thanks for the answer.

Why is it necessary to quote the ZAR Rand value when completing the form, surely the pricing will be different when you redeem my BTC, does your organisation keep the difference and secondly what other charges are applicable if I were so appoint you. I look forward to your comments
