LIQUIDATION – SIMPLE – HOW TO DO IT

 

  1. Submit your Liquidator Nomination Form - You need to have submitted your LIQUIDATOR NOMINATION FORM by 10h00 South Africa time,  on 4 Jan 2021. Late submissions will not be accepted.

(CUTOFF TIME)

  • 11h00: Pretoria
  • 04H00: New York
  • 09h00: London
  • 18h00: Tokyo

 

Liquidators recommended by RAG:

1. Company Name: Sebenza Trust/Liquidation Experts

     

    2. Company Name: Investrust Insolvency Practitioners

     

    3. Company Name: Tygerberg Trustees

       

      2. Appointment of the Liquidator

      The Liquidator is appointed by the Master of the High Court  in terms of the Requisitions received from the Creditors. More than one Liquidator can be appointed. The Master of the High Court has the discretion to make a discretionary appointment.

      We do not know when the Liquidator will be appointed but it should be imminently.  The RAG website will be updated with the relevant details on receipt.

      3. How does a creditor ensure that he/ she receive information from the liquidator about the winding up process?

      RAG will keep the creditors updates with the relevant development on the case via updates on the RAG website.

      You can also contact the Liquidator's office, requesting to be added to the relevant creditor's mailing list.

      4. What is the purpose of a First and Second Meeting of  Creditor’s.

      The purpose  of the meetings are to provide creditors’ claims and to vote on important issues such as the Appointment of the Final Liquidator as well as to provide the Liquidator(s) with directions (i.e. whether to institute legal action) and to interrogate witnesses.

      RAG will keep the creditors updated on the status of events. Due to the magnitude of the case, geographic diversity of the creditors and COVID restrictions, meeting of the creditors may need to be adapted to cater for the specific conditions.

      5. Do I have to submit a claim after signing the Requisition?

      No.

      6. What about court actions pending against the company?

      All Legal action stops immediately once Liquidation proceedings have been instituted.

            Firstly, THANK YOU FOR ALL THE WORK YOU AND CHRIS are doing.
            I dont want to be out of line, but I can still do P2P, so to make life easier, can I move “my” bitcoin from my children accounts and submit 1 claim and proof of the Trading Pool balance?
            Would be easier for the refund process aswell. Reduces the amount of claims to process.

I’m an investor in MTI because Johann Steynberg registers our bitcoin funds, which has the correct, trusted in it, in the company, his wife Nerina should declare to her husband Johann Steynberg that the company is working, that he registers the MTI company , if you do not want to follow that devolve the bitcoin to all, ya that is money that invests and that he has not recovered at the time of the investment. Who sent in the directories of Btc. Which is in the back office.

      I submitted my nomination form already. I however forwarded it to Manci & Knoop and, not to one as listed supra. DoI need to resend this to one of the above.
      The amount I entered was only the total I deposited into MTI. The amount does not include the Trading Pool balance and Pending withdraw amount.

      How are they going to handle payouts given the fact that the value of bitcoin keeps changing? I’m concerned that by putting todays value of our bitcoin on our claim we are signing over any value that not oin accrues between now and when the payout is made. If bit oin continues to rise at the rate it has been this month, that would be a substantial loss for many members…not only in the value we get paid but also in the fact that we would then have no bitcoin and would have to purchase it at the higher current market rate, when we were reimbursed a lower market rate. Will there be adjustments made at the time of payouts to compensate for the very likely increase in the value of bitcoin?

      There is confusion about the amount to be claimed. The nomination form refers to Investment amount. This is the amount that was put on our nomination form. Do we have to inform the liquidator about it?

      The information provided here is vague, at best. You refer to the completion of a form, yet there are links to three separate forms. Are MTI investors to complete all three of the forms? Is it a requirement that all investors participate in the nomination? While I certainly appreciate the dissemination of relevant information, it is not at all clear from this page what investors should be doing.

        Susana, because of the holidays and the vast number of people having to do the filling in of the forms and requisitions. There has been delayed to give everybody an opportunity to get the forms and requisitions in. Please get them in the Saturday and don’t overload our system with late arrival forms on Sunday. You will subsequently be contacted and your claim can then be processed as well.

      Hi Sharon. I sent my forms in on the 30th and was told on one of the MTI groups to only put down my initial investment which I did. I did not put Down the actual bitcoin amount and value in rands as of the 31 December. Does it matter at this stage as it is nearly triple the value, or will the actual bitcoin amount in account be sorted out at a later stage?

      Hi. I am still not sure what to do. It seems uplines are keeping very quiet about suggestions to their downlines and are also vague when asking what one needs to do. The whole thing about nominating a liquidator is very confusing and seems extremely rushed and it is not giving one any time to look into the nominations. As such forms have still not been filled in as we are very confused about the whole situation. Can someone please help in this regard. Thanks

        It is imperative that you submit your requisition form today. The sooner a liquidator is appointed, the sooner they can start with the process of recovering our Bitcoin. The longer we take, the more time is there for the management of MTI to get their hands on the wallets.

      For the amount, why can we only claim for what we originally invested and not for the growth the bitcoin has had?

      If the investors only get back what they originally invested, where will the growth surplus money go?

      first of all, thank you all for all the hard work that you do and the effort to regain everyone’s investment.

      if i understand correctly, the liquidator with the majority of forms(basically votes) is appointed by the high court, after which it will be his/her job to regain access to the assets and make them “liquid” in order to payout everyone’s investment.

      I just have 3 questions for clarification:
      Q1: If you submitted a requisition form to a different liquidator than which eventually will be appointed, are you still able to claim your investment with the appointed liquidator?

      Q2: what are these “liquidator meetings” i’ve been reading/hearing about, when will these take place and what is expected of me as a MTI investor at that point?

      Q3: at what stage in the process are we as investors supposed to make a claim for our investment and how do we do that? what proof of our investment is required for the claim to be succesfull?

      I know it is a lot but the questions above are from several other people in my team as well.

      It appears that I am too late to take part in the appointment of a Liquidator.Where does this leave me in term of my claim against MTI?
      Also on the nomination form I note that claimants are referred to as CREDITORS.I certainly don’t see myself as a creditor but rather as an investor, as I did’nt lend any money to MTI.I did however invest money with them. I am not sure that this is not just a technicality but I do not want to be paying any money IN after all is said and done, on account of the liquidators not being able to find enough assets to cover the legal costs.
      Lastly can somebody please give an indication as to whether the Liquidators will be able to access the BITCOIN held by MTI?

      Hi I onely accessed e-mail after the festive season.Should i still bother filling in the forms or is it already past the cut off date? If i have not filled in and submitted the forms,will the outstanding oauouts of the claimed amounts still be dealt with by the liquedators in future or was it compulsory to have filled in the forms to get assistance ?

        The nomination process was only to get a liquidator appointed and not to submit a claim.

        The liquidators will advise on the next steps investors have to take in order to lodge our claims.
