  1. I understand that application has been/is to be made to the Supreme Court for an order for the sequestration/voluntary surrender of the estate of the Debtor and for the placing of the Debtor in provisional liquidation/under judicial management.


  1. I declare that ________________________________________________________(“the Creditor”) is a creditors of the Debtor.


  1. In my opinion it is in the interest of the creditors of the Debtor that a provisional trustee/liquidator/judicial manager be appointed in the estate of the Debtor for the reasons set out hereunder:- TO TAKE CONTROL OF THE ASSETS


  1. I hereby nominate CHRISTOPHER JAMES ROOS of SEBENZA TRUST, P O Box 14527, HATFIELD, 0028; Telephone number (012) 7555225 for appointment as the provisional trustee/liquidator/judicial manager and request you to make the necessary appointment. The Creditor intends proving a claim and voting for the final appointment of the aforementioned person at the first meeting of creditors in this estate.


  1. I declare that the Creditor is not a person disqualified, in terms of the provisions of Section 52 and 53 of the Insolvency Act and Section 365(2)(a) of the Companies Act, from voting for the appointment of the aforesaid person as trustee/liquidator/judicial manager.  As far as I am aware the nominated person is not disqualified from the aforesaid appointment by virtue of the provisions of Section 55 of the Insolvency Act or Section 372 of the Companies Act.


  1. I further declare that I have satisfied myself that the amount reflected herein as owing by the Debtor to the Creditor is, to the best of my knowledge and belief, true and correct.

Good morning
This morning when I attempted to log on to my MTI account, in order to calculate the current value of the bitcoin I invested, my username/password did not match. I then changed the password, and am still denied access.

        The liquidation nomination forms was to appoint the best possible liquidators for the benefit of all members. You didn’t need to submit a form in order to get your BTC back. Everyone that is owed BTC from MTI are going to stand a change to get their funds back.

In my humble and brief opinion, RAG is going about this process totally in the wrong way (in the process of recovering the investments of the members of MTI).
1. Only 1 (one) Liquidator should be appointed in the interest of all the Members (investors) of MTI.
2. RAG through the Liquidator and with a High Court Order should trace, take possession and freeze all the Bitcoins that MTI has been purporting to hold on behalf of the Members, the investors.
3. At the same time RAG and the Liquidators (with the High Court Order) should demand and obtain from MTI a list of all the MTI Members together with the outstanding balance of their Investment.
4. The Trading Balance in each Investor’s account should be transferred to the Investor’s own Income Wallet.
5. The sum of all the Wallets of ALL the Investors will represent the extent of what is due by MTI to the Investors (in Bitcoins).
6. All claims by the Members should be made in Bitcoin and not in ZAR or any other currency, in order to avoid incorrect valuations, in the interest of All Investors.
7. All legal expenses should be paid by selling Bitcoins in the amount necessary to cover those costs and expenses.
8. The final distribution should again be made in Bitcoin proportionally and to the extent of each Members value of their investment. This will address timing differences in values while doing personal valuation by individual Investors of their own Investment, and the issue of rates of exchange for non South African Members.
9. Ideally all Members should agree to this course of action.

    RAG has taken the best legal advise, from a team of experts, who have traced an overwhelming amount of BTC in another scam. We are in very good hands here. The Courts decide how many liquidators need to handle the case. The BTC/ZAR conversation was discussed this evening again. I am not clear on the direction here. Am I to believe that I am supposed to fill this form out (which doesn’t include any pertinent member information) and sign over the rights to my bitcoin to this liquidator? You still don’t even know anything about my account. So I am supposed to trust this group, who are the same people who recruited for MTI?

    I am as the same mind as you Thomas, I was sent to this website via a link from an email response by MTI and I am supposed to trust this, when we were told to trust MTI. My question is MTI (the alleged scammers) would surely not send a link to a group of people that are trying to get investors BTC back, If the RAG team are not part of MTI management then how did the link to this website get sent to me via an MTI autoresponse email. Doesn’t make any sense. To the RAG team, please don’t just tell us to trust the process (trusting got us into this mess in the first place) Please clarify as to how you were able to get your link in autoresponder MTI emails if you are nothing to do with MTI. You know the saying once bitten twice shy.

        No need to worry. That was just a nomination form to appoint a liquidator and not a claim form. As soon as the liquidator is appointed, they will advise as to what the next steps are that we have to take.

I have submitted Requisition forms To Tygerberg Trustees before and via the RAG website so now I’m not sure if I must submit again.

    It is extremely difficult to estimate the time it will take. Almost like saying how long is a piece of string. Normally these cases can take anything from one year to 3 or more. It depends a lot on how helpful the senior and management staff of MTI are going to be.

    The form was just to nominate a liquidator.

    A liquidator will be appointed by the High Court soon and then they will then let us know how to claim back our investment.

    The liquidators will not have time to send confirmation messages to all the investors who sent forms.

    The nomination process was only to get a liquidator appointed and not to submit a claim.

    The liquidators will advise on the next steps investors have to take in order to lodge our claims.
